New President elected

Peter den Dekker, corporate insurance risk manager at Dutch multi-national Stork, has been elected President of the Federation of European Risk Management Associations (FERMA). He took over from Marie-Gemma Dequae, who held the post for two years, following the meeting of the general assembly of FERMA in Brussels this week. Den Dekker represents the Dutch risk management association NARIM on the board of FERMA.

Den Dekker worked as a broker and underwriter in the industrial insurance market before becoming group insurance risk manager at the quoted Dutch multinational Hagemeyer in 1999. He joined Stork in 2006.

Stork is one of the oldest industrial companies in the Netherlands and has four groups serving a number of markets worldwide. The groups are aerospace, food systems, technical services and print.

Den Dekker said: "I am delighted to become chairman of FERMA as it continues to grow in its ability to represent the interest of risk managers across Europe, as shown by our activities during the year and Prague as the venue for our 2009 Forum. I look forward to welcoming FERMA members and our friends from the risk management community there in October."

The FERMA general assembly meeting in Brussels this week also elected to the board Michel Dennery, Deputy Chief Risk Officer of GDF Suez, as the representative of the French risk management association AMRAE. Stefan Sigulla of the German association DVS and Paul Taylor of the UK association AIRMIC continue as FERMA's vice-presidents for 2009-2010.

FERMA is made up of the national risk management associations of 16 countries. It represents over 5,000 individual members and a wide range of business sectors from manufacturing to financial services, charities and health organisations as well as local government organisations.

Member associations are from the following countries: Belgium (BELRIM), Bulgaria (BRIMA), Czech Republic (ASPAR CZ), Denmark (DARIM), Finland (FinnRiMa), France (AMRAE), Germany (Bfv & DVS), Italy (ANRA), Netherlands (NARIM), Poland (POLRISK) Portugal (APOGERIS), Russia (RusRisk), Spain (AGERS), Sweden (SWERMA), Switzerland (SIRM) and United Kingdom (AIRMIC).

The FERMA Forum 2009 will take place from 4-7 October at the Congress Centre in Prague with the theme "Global Village: the future of risk management". The programme and registration details are available on the FERMA Forum website.

06.04.2009FERMA WELCOMES THE COMMISSION REPORT ON RENEWAL OF THE INSURANCE BER

The Federation of European Risk Management Associations (FERMA) welcomes the European Commission Report in favour of renewal of the Insurance Block Exemption Regulation (BER). The legal certainty provided by the current BER has fostered cooperation among insurers to create competitive insurance markets with sufficient capacity to meet the needs of large international insurance programmes. A renewed BER in March 2010 will continue to achieve this fundamental objective by exempting joint calculations, tables and studies, and co-(re)insurance pools from EU competition rules.

Regarding joint calculations and studies, FERMA is pleased to note that the Commission Report takes on board the concerns raised by large commercial buyers and agrees that there is a continued need for a BER in this area. Joint calculation on the actual cost of risk is key to market access by new entrants. While the Commission intends to clarify existing boundaries and to limit the scope of exemption to valuable information exchange, FERMA welcomes the transparency initiative, which would allow insurance buyers to take part in and to have access to data jointly generated by insurers.

In relation to pools, the Commission finds that renewal of the BER is necessary not only to clarify the safe harbours, but also to induce compliance by pool members. FERMA agrees with this approach while recognising that pools should be a last resort to cover risks that are new or difficult to insure where a large capacity is required. FERMA believes that pools should be an alternative to commercial insurers and operate in a competitive environment. FERMA will articulate views and recommendations to ensure that pooling arrangements operate to the benefit of large commercial buyers.

Finally, FERMA takes note that the Commission has not endorsed the view of the industry to the effect that cooperation in relation to standard policy conditions (SPCs) should continue to be covered by the BER. Cooperation on SPCs is, however, very valuable to large commercial buyers as it reduces transaction costs, facilitates the comparison between policy conditions and provides better contract certainty. Accordingly, FERMA believes that, to the extent that SPCs will fall outside of the BER, the Commission should at the very least issue guidance so as to provide sufficient comfort and legal certainty as of March 2010.

The President of FERMA, Marie-Gemma Dequae, has stated, "FERMA is pleased with the Commission's support for renewal and will continue to be closely involved in the debate for the adoption of a recast BER next year".
